These Terms of Sale ("Terms") govern all purchases made from Leadership Books, Inc. ("Company," "we," or "us") via https://LeadershipBooks.com, https://LeadershipCourses.com, and any affiliated websites, digital platforms, funnels, and tools operated by us, including those hosted through third-party systems such as Go High Level (collectively, the "Sites"). By purchasing any product or service from us, including but not limited to books, online courses, digital downloads, physical goods, and bundled offers ("Products"), you agree to these Terms.

1. Product Descriptions & Availability

We strive to ensure that all Products are accurately described and available as shown. However, we do not warrant that descriptions, availability, pricing, or other content on the Sites is error-free. We reserve the right to modify or discontinue any Product at any time without notice.

2. Pricing, Taxes & Discounts

All prices are listed in U.S. dollars. Applicable taxes may be added where required by law. Promotional discounts are subject to change and may not be combined unless explicitly stated.

3. Payment & Billing Authorization

By providing a payment method, you represent that you are authorized to use it and authorize us (and our third-party payment processors, including but not limited to Stripe, PayPal, ClickBank, and others) to charge the full amount for your order, including taxes and fees. All payments are due at the time of purchase unless an installment or subscription plan is expressly offered.

4. Subscriptions & Recurring Charges

Some Products (e.g., memberships or multi-part courses) may involve recurring billing. By enrolling, you authorize us to charge your payment method automatically at the agreed-upon interval. You may cancel future billing at any time by contacting us. No partial refunds will be given for unused subscription periods.

5. Refunds, Returns & No-Refund Policy

All sales are final. We do not offer refunds on any Products, including digital content, downloadable materials, or physical goods, unless otherwise stated in writing. By completing a purchase, you acknowledge and agree to this no-refund policy.

6. Delivery of Products

Digital Products are typically delivered via email or through your user dashboard immediately upon successful payment. Physical Products will be shipped to the address you provide during checkout. We are not responsible for delivery delays caused by incorrect shipping information or third-party carriers.

7. Chargebacks & Payment Disputes

By completing a purchase with Leadership Books, Inc., you affirmatively agree not to initiate a chargeback or payment dispute with your credit card provider or bank for any authorized transaction. All chargebacks are strictly prohibited unless there has been verified fraudulent use of your payment method.

Under Nevada law (NRS 597.995), consumers may contractually waive certain rights if the waiver is knowing, voluntary, and not unconscionable. Leadership Books, Inc. complies with these requirements by presenting its no-chargeback and no-refund policy in clear, standalone terms during the purchase process, and requiring affirmative acknowledgment.

This no-chargeback policy is further supported by federal case law (e.g., Bakov v. Consol. World Travel, Inc., 2019) affirming a merchant's right to recover funds where a customer violates a signed waiver. Accordingly, any attempt to initiate a chargeback or reverse a payment in violation of these Terms may result in legal action to recover the full amount of the transaction, along with any associated fees, damages, and collection costs.

You agree that disputes related to payments, chargebacks, or refunds shall be governed exclusively by the laws of the State of Nevada and adjudicated in the courts of Clark County, Nevada. By submitting payment, you acknowledge and accept this condition of sale. without first contacting us to resolve the issue is a violation of these Terms. We reserve the right to block future access to our Sites, Products, or Services for users who engage in such activity.

8. Licensing & Intellectual Property

When purchasing a digital Product, you are granted a limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes only. You may not share, reproduce, modify, or redistribute the content without our written permission.

9. Sales Disclaimers

Leadership Books, Inc. makes no guarantees regarding the outcome, results, or success of any Product purchased. All Products are provided "as is" and are intended for educational or informational purposes only. Past performance is not indicative of future results.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your purchase or use of any Product, even if we have been advised of the possibility of such damages.

11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Nevada. Any disputes arising from a purchase will be resolved exclusively through binding arbitration in Las Vegas, Nevada, in accordance with the rules of the American Arbitration Association. You waive any right to a trial by jury.

12. Updates to These Terms

We may update these Terms from time to time. Any changes will be posted on this page and take effect immediately upon publication. Your continued purchase or use of Products after changes constitutes your acceptance.

14. Electronic Signature and Acceptance

By clicking “Buy Now,” “Enroll,” or any similar button, or by completing a transaction through our Sites, you affirmatively consent to these Terms of Sale. This action constitutes your electronic signature under the U.S. E-SIGN Act and has the same legal effect as a handwritten signature.

15. Severability and Survival

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect. Any provisions that by their nature should survive termination (including those relating to refunds, chargebacks, intellectual property, and dispute resolution) shall do so.

16. Entire Agreement and No Waiver

These Terms constitute the entire agreement between you and Leadership Books, Inc. regarding your purchase. No oral or written statement outside these Terms will modify or override them unless agreed to in writing by Leadership Books, Inc. Our failure to enforce any part of these Terms shall not be deemed a waiver of our rights.

17. Restatement of No Refund and No Guarantee Policy

For the avoidance of doubt, all sales are final and non-refundable. By completing your purchase, you acknowledge that you have received full disclosure of this policy and agree to waive any future claim for refund or credit. Leadership Books, Inc. does not guarantee any specific outcomes or results from the use of its Products or Services. All content is provided "as is," for informational and educational purposes only.

18. Export Compliance

You may not use, export, or re-export any of our Products or Services except as authorized by United States law. In particular, but without limitation, Products may not be exported or re-exported into any U.S.-embargoed countries or to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals. By purchasing, you represent and warrant that you are not located in, under control of, or a national or resident of any such country.

19. Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, war, terrorism, supply chain disruption, internet outages, labor shortages, natural disasters, or changes in applicable law.

20. Third-Party Tools

Certain Products or Services may involve the use of third-party platforms or tools (e.g., Stripe, PayPal, ClickBank, GoHighLevel). Leadership Books, Inc. is not responsible for the functionality, availability, or accuracy of these third-party services and disclaims any liability arising from their use.
